Cuales Son Mis Derechos (What are My Rights)?: ICE & Immigration Arrests
Recently, the Trump Administration has taken the shotgun approach of trying to arrest and deport anyone it deems undesirable–whether undocumented or a U.S. citizen. The Government has even taken the extraordinary and unprecedented step of deporting people without a court hearing to a quasi-concentration camp in El Salvador. Consequently, it is more important than ever to know your rights.
Although immigration law is NOT the same as criminal law, you do have certain rights that you should know in case the Government attempts to detain or question you. The following are just a few of the rights and facts you should always keep in mind when dealing with ICE and the immigration system:
(1) You should always remain silent and never sign anything.
(2) Always ask to speak to a lawyer, but say nothing else.
(3) If the police come to your home, do not let them inside even if they have a warrant. Administrative warrants issued by the Department of Homeland Security do not grant agents permission to enter your home. Keep your front door shut at all times!
(4) ICE agents will lie and use tricks to try and detain you, for example, posing as a pizza delivery driver to get you to open your front door or posing as local police officers investigating fake crimes. You can learn more about these fake ICE ruses here.
(5) Never run away from ICE agents, do not give them fake documents, and do not give out false information–REMAIN SILENT!
